Businesses, whether large or small, often need to purchase, acquire, or lease real property and there is a wide body of federal and state laws that may apply to any real estate transactions entered into by a business. Mitchell-Phillips Law, P.C. will represent your businesses in their commercial and residential real estate transactions including but not limited to:
Sale and Purchase: In the sale or purchase of real estate, the Firm drafts and reviews purchase and sales contracts, assignments and assumption agreements, notes & deeds of trusts, escrow agreements, estoppels certificate
Leasing: Representing landlords and tenants (if no conflict of interest) for office and retail leases, Mitchell-Phillips reviews, drafts, and negotiates lease agreements and like instruments for its clients. The firm also structures lease-to-purchase agreements.
Investment: The Firm assists clients with their real estate investments by, (1) establishing the investment vehicle (e.g. LLC or other form of entity), (2) representing the client at the closing (including the performance of all necessary pre-closing activities), (3) transferring the property to the investment entity, and (4) drafting/reviewing tenant leases and agreements.
Asset Protection: The Firm counsels clients on the transfer of their property to testamentary instruments, such as land trusts and living trusts, and in the use of legal entities to protect their property.
